General terms and conditions

For tandem flights

By making a booking, the passenger confirms that they have read, understood and accepted these terms and conditions.

The contract is concluded when the passenger makes a firm booking of the flight. Should any provision of these terms and conditions prove to be wholly or partly void or unenforceable, the validity and effectiveness of the remaining provisions shall remain unaffected.

The pilot is the commander of the tandem paraglider, and the passenger undertakes to follow the pilot’s instructions.

The passenger confirms that they do not suffer from any health problems (mental or physical) that could affect the safe conduct of a tandem paraglider flight.

The passenger is aware that a tandem paraglider flight involves risks. With a paraglider, for example, the legs of the pilot and the passenger serve as the landing gear, which can lead to injuries in the event of a hard landing or an aborted take-off. In addition, the risk of a sudden and unforeseeable effect of the wind cannot be ruled out. The company Les Artisans du vent and its pilot Maël Porret hold third-party liability insurance of CHF 5 million for non-commercial flights and CHF 10 million for commercial flights. In the event of personal injury or damage to property suffered by the passenger during a paraglider flight, the liability of the company Les Artisans du vent and its pilot Maël Porret is limited to the amount corresponding to the type of flight concerned.

Passengers who are minors or under guardianship require the permission of the person holding parental authority or of a legal representative. If that person is not present at the time of the flight, a written declaration of consent must be presented in advance to Les Artisans du vent and its pilot Maël Porret.

The dates for tandem flights are set in advance, sometimes at short notice. A set date may be changed when the weather conditions or organisational reasons require it. The final decision as to whether or not a flight can take place lies exclusively with the pilot.

If the passenger cancels the flight although it could have taken place, the following rules apply to the refund of the flight price:

The company Les Artisans du vent and its pilot Maël Porret hold accident insurance for the passenger, valid in Switzerland only, with a maximum cover of CHF 100,000 for medical treatment costs. Benefits from this accident insurance may be claimed once the benefits from any accident insurance held by the passenger have been exhausted. The obligation of the company Les Artisans du vent and its pilot Maël Porret to provide benefits for claims arising from the consequences of an accident is limited to the benefits covered by the insurance for the tandem flight and to the cover limit of that insurance.

The pilot decides whether and how mobile phones and cameras may be carried.

In the event of any dispute arising from the tandem flight, passengers from the USA and Canada explicitly waive any jurisdiction in the USA or Canada and acknowledge that neither the company Les Artisans du vent nor its pilot Maël Porret will accept jurisdiction in the USA or Canada.

Only the ordinary courts at the registered office of the company Les Artisans du vent in Fresens have jurisdiction over any dispute arising from the contract concluded for the tandem flight. Swiss law alone applies.
